HUNTINGTON -- A Kentucky man and his insurance company have filed suit against a Cabell County woman, alleging she caused him to run off the interstate after entering his lane.

James Vessels was driving his Kenworth Tractor and Fontaine Trailer West on Interstate 64 near mile marker 8 on Feb. 21, 2007, when Tammy Jo Adkins lost control of her vehicle and collided with Vessels' tractor-trailer, according to the complaint filed Jan. 15 in Cabell Circuit Court.

As a result of the collision, Vessels' tractor-trailer slid across I-64 and suffered "extensive damage," the suit states.

After the accident, Vessels' insurance company, First Guard, paid him $24,035.47 to repair the damage to his tractor-trailer, it claims.

Because of the accident, Vessels was unable to work for an extended period of time and incurred lost wages, according to the complaint.

He also incurred a $1,000 out-of-pocket loss to pay his deductible for his policy with First Guard, the suit states.

In the two-count complaint, Vessels and First Guard are seeking $48,070.94, plus pre- and post-judgment interest, costs and attorney's fees.

They are represented by Robert H. Sweeney and John Andrew Hess of Jenkins Fenstermaker in Huntington.
