CHARLESTON -- A Kanawha County couple is suing Loop Plaza Pharmacy after a prescription caused toxicity.

On May 23, 2011, the defendant filled a prescription for Methotrexate and provided it to Ruth Vaughan with instructions to take one 2.5mg tablet by mouth twice daily, according to a complaint filed Dec. 29, 2011, in Kanawha Circuit Court.

Vaughan claims she took the prescription as instructed and subsequently became ill and developed neutropenia, diarrhea, thrush, rash and weakness.

The illness was determined to have been caused by Methotrexate toxicity, according to the suit.

Vaughan claims at the time the prescription was filled, the pharmacist knew or should have known that taking 2.5mg of Methotrexate twice daily exceeded the recommended maximum dose of Methotrexate per week.

The defendant owned Vaughan a duty of care to act in a reasonably prudent manner when filling prescriptions through its agents, according to the suit.

Vaughan and her husband, Filmore Vaughan, are seeking compensatory damages with pre- and post-judgment interest. They are being represented by William S. Druckman and Madonna C. Estep.

The case has been assigned to Circuit Judge James C. Stucky.
